NOTICE AND WARNING TO THE PUBLIC
BAYER INTELLECTUAL PROPERTY GmbH (“Bayer IP”) hereby notifies the public that it is the rightful holder and owner of Philippine Patent No. 1/2007/501642, issued on March 25, 2013, and valid until January 19, 2026. This patent pertains to the prevention and treatment of thromboembolic disorders by administering rivaroxaban, a direct factor Xa inhibitor, once daily in a rapid-release tablet to patients in need. The products under this patent are marketed and distributed by BAYER PHILIPPINES, INC. (“Bayer Philippines”) and are sold under the brand XARELTO (10, 15, 20 mg rivaroxaban). Representations of the authorized products are shown below:
Under the law, it is illegal for any person or entity to manufacture, use, offer to sell, or sell pharmaceutical products that contain elements of the patent claims or their equivalents, or to exploit the patent in any manner without obtaining consent, authorization, or a license from Bayer IP. Any such acts would constitute patent infringement.
Bayer IP and Bayer Philippines have become aware of entities intending to distribute products that infringe upon Philippine Patent No. 1/2007/501642. Products that are not sourced from Bayer, including Bayer Philippines, are not licensed under the patent, and their safety and effectiveness cannot be guaranteed by Bayer. WARNING IS HEREBY GIVEN that the use and distribution of unauthorized products constitute patent infringement and will constrain Bayer IP and Bayer Philippines to take immediate legal action against persons or entities found to be engaged in such acts.
