Panlilio-owned BHI claims to Friday’s Resort Boracay land is false, says Yap-Sumndad

Recent news reports and claims by Boulevard Holdings Inc. (BHI) that it owns the land where Friday’s Resort Boracay stand are wrong and erroneous, the real owner of the property Mila Yap-Sumndad said in a statement.

A portion remains to be their property that BHI and Friday’s Holdings Inc.illegally entered and now occupies, she added.

“I inherited the parcel of land from my father and mother and when the lease ended on Feb. 14, 2014, we just took back what was rightfully ours. The claims of Panlilio-owned BHI, the mother company of Friday’s Boracay Beach Resort and Friday’s Holdings Inc., are based on a Makati RTC decision of Branch 132 dated Feb 3, 2014 that the Court of Appeals stopped on December 10, 2014,” Yap-Sumndad said.

“BHI then went forum shopping and misled the Courts in Aklan, not reporting that there was a Court of Appeals ruling on the matter, where they used the Buruanga (-Malay) Sheriff and massive number of police to takeover our property. These are the true facts and what they did was illegal,” she added.

Mrs. Yap-Sumndad said she is being made to look like a villain at every instance when she in fact is the victim due to the various court cases that BHI has initiated against her and has had to fight in order to protect her property.

“Ang dami na nilang na involve dito sa mga press release nila, una si Cong. Haresco, tapos si Cong. Ronald Singson, ngayon, yung may ari naman ng AMA. It seems hindi sila talaga titigil sa panloloko nila sa mga investors ng BHI. At least nadulas sila sa isang comment nila sa pahayagan na binayaran nila yung mga police dun sa forceful entry noongMarch last year. The truth is in the Court of Appeals decision that ordered the Makati RTC to conduct a retrial because of the evidence discarded by Branch 132 of the Makati RTC,” she said.

“The Court of Appeals called on all agents of government to defer from implementing the writ of execution decision of Makati RTC 132 on which the claims of ownership of BHI and Friday’s Holdings Inc. rests. So in essence, their claim of ownership, is baseless. How can you posses something you do not own?” she added.

Policemen and officers who took part in the break in of the Sumndad property are now facing investigation for their participation.

In a recent press statement with The Manila Times, Panlilio was quoted as saying that they spent so much of investors money in paying for lawyers and the police.

“Whenever BHI submits their report to PSE, it makes it appear that I am a criminal trying to steal property when it is actually the other way around,” Mrs. Yap-Sumndad said.

“Boulevard Holdings Inc. and their subsidiary Friday’s Holding Inc. is the aggressor in this case. I will be requesting the PSE for an investigation on BHI as on several occasions. BHI reports are being used to attack my reputation in media and prop up their stock prices to the detriment of the market and their shareholders,” she added.

“In addition, my lawyer is already studying further legal action on the malicious actions of BHI. I will continue to fight for what is rightfully and lawfully my property and what is to be inherited by my children. I hold in my hands the original tax declaration for the property and any maneuver by BHI and Mr. Panlilio in the courts to wrongfully wrest ownership will be legally contested. I will not remain silent against the lies of Boulevard Holdings Inc. and its chairman,” she said.

Trial is on going at Branch 146 RTC Makati per the Court of Appeals ruling.

Branch 146 of Makati RTC issued a Writ of Preliminary Injunction last January 13, 2015, where it ordered that the proceedings and other pending issues in relation to the Writ of Execution be suspended until further order from the higher court.
